To the Constable(s) of the Town of Rochester in the County of Plymouth,
Greetings,
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said town qualified to vote in elections and in town affairs to meet at the Rochester Memorial School Cafetorium in said Town on Monday, the 2nd of June 2008 at seven p.m. (7:00 p.m.) in the evening to act on the following articles:
ARTICLE 1: ANNUAL REPORT OF TOWN OFFICERS AND COMMITTEES
To see if the Town will accept the annual report of all town officers and committees,
or take any other action thereon.
ARTICLE 2: ELECTED OFFICIALS SALARIES
To see if the Town will vote to fix the salaries of the elected officials of the Town for the Fiscal Year 2009 as follows:

ARTICLE 3: PERSONNEL BY-LAW AMENDMENT - CLASSIFICATION AND COMPENSATION PLAN
To see if the Town will vote to amend Part IV, Classification and Compensation Plan or take any other action thereon.
ARTICLE 4: TOWN OF ROCHESTER FY 2009 OPERATING BUDGET
To see if the Town will vote to raise and appropriate and/or transfer from available funds ------a sum of money to defray Town charges and expenses for the Fiscal Year ending June 30, 2009, or take any other action thereon.
ARTICLE 5: NATURAL RESOURCE EXPENSES
To see if the Town will vote to raise and appropriate and/or transfer from available funds a sufficient sum of money to fund the following recurring Environmental & Natural Resources Expenses or take any other action thereon.

ARTICLE 6: HUMAN SERVICES
To see if the Town will vote to raise and appropriate and/or transfer from available funds a sufficient sum of money for the purposes of funding the following Human Services for the Fiscal Year 2008 or take any other action thereon.

ARTICLE 7: DEPARTMENTAL REVOLVING FUNDS AUTHORIZATION
To see if the Town will vote to authorize revolving funds for certain town departments under Massachusetts General Laws Chapter 44 Section 53E 1/2 for the Fiscal Year Fiscal Year 2009 or take any other action thereon.
ARTICLE 8: CHAPTER 90 FUNDS APPROPRIATION
To see if the Town will vote to accept the provisions of Chapter 291D of the Acts of 2004 of the Commonwealth of Massachusetts and appropriate the sum of $231,887 from available funds or take any other action thereon.
ARTICLE 9: TREE WARDEN POSITION
To see if the Town will vote to change the position of Tree Warden from an elected position to an appointed position and to place this question on the ballot of the next annual election:
"Shall the Town vote to have its elected Tree Warden become an appointed Tree Warden of the Town? Yes___ No ___.
Or take any other action thereon.

ARTICLE 10: FINANCE COMMITTEE BY-LAW - MEMBERSHIP
To see if the Town will vote to strike from Section 1 of the Rochester Finance Committee By-law:
"Section 1. There shall be a Finance Committee of seven (7) members, who are residents of the Town."
And insert in its place the phrase:
Section 1. There shall be a Finance Committee of five (5) members, who are residents of the Town."
Or take any other action thereon.
ARTICLE 11: PERSONNEL BY-LAW - VACATIONS
To see if the Town will vote to amend the Personnel By-laws as follows:
Part VIII
Vacations
Delete: paragraph eight (8)
Insert: the following
Annual vacations shall not accumulate from year to year except when vacations cannot be taken for the Town's best interest, as determined by the Department Head or Board of Selectmen. A total of five (5) vacations days may be carried forward to the next year and must be used within ninety (90) days of the employment anniversary date."
ARTICLE 12: GENERAL REGULATIONS - SECTION XI(B) POSTING BULLETIN NOTICES
To see if the Town will vote to amend the By-laws as follows:
Section XI General Regulation
B. Posting Bulletin Notices
Delete:
"The junction of Cushman and Hartley Roads"
"The junction of Mary's Pond and County Roads"
"North Avenue by the Telephone Exchange"
Insert:
"The Plumb Library"
"Council on Aging"
"The Town Meeting Warrant shall be posted on the Rochester website"
ARTICLE 13: AMEND SPECIAL RESIDENTIAL DEVELOPMENT ZONING BY-LAW, SECTION XVIII
To see if the Town will vote to amend the Special Residential Development Zoning By-law, Section SVIII as follows:
Delete: subsection C.16 and substitute the following:
16. Common Water and Sanitary
a. Common Sanitary facilities are encouraged consistent with the applicable Board of Health and State regulation.
b. For potable water, projects shall be services entirely by Municipal Water or by a Public Water System as defined in 310 CMR 22.00. if the project is not served by Municipal water and regardless of number of service connections or number of individuals served, any ground water source that is part of the system shall comply with 310CRM 22.21 Groundwater Supply Protection and the Massachusetts Department of Environmental Protection (DEP), Drinking Water Program's "Guidelines and Policies for Public Water Systems" as they presently exist and any subsequent amendments. Further, should the DEP for any reason, choose to not assert its jurisdiction, the applicant shall still comply with the technical requirements of the regulations and guidelines.
